1) Who we are

These Terms & Conditions (“Terms”) govern your use of aqari.injazrt.ae and related Aqari digital channels (including WhatsApp intake) operated by Injaz Real Estate Trustee LLC (“Injaz”, “we”, “us”, “our”), a DLD-approved Registration Trustee. 2) What Aqari is (and isn’t)

Aqari is Injaz’s remote channel for trustee services such as WhatsApp-based Ejari and digital intake for DLD services. Aqari helps you submit documents, make payments via approved gateways, and receive outputs/receipts, but final approvals, fees, and outcomes are determined by the Dubai Land Department (DLD) and may change when DLD updates its rules or systems. 3) Acceptance of Terms

By using Aqari (website or WhatsApp), you agree to these Terms and to our Aqari Privacy Policy. If you do not agree, please do not use Aqari.

4) Eligibility & authority

You confirm you are legally competent to contract and, where acting for another person or a company, that you have valid authority (e.g., POA, company signatory rights). Certain services require original or certified documents as per DLD policy. (Dubai Land Department)

5) Services & process

• Typical Aqari flows include remote Ejari registration/updates via WhatsApp, uploading documents, data verification, fee assessment, payment, and issuance of acknowledgments/receipts or updates to DLD records. (Gulf Business)

• Service descriptions on Aqari are informational; the definitive process, forms, and fees are set by DLD. (Dubai Land Department)

• We may refuse, suspend, or request additional information where documents are incomplete, inconsistent, or raise compliance concerns.

6) Accounts, communications & e-signatures

• You may interact via website forms, email, phone, or WhatsApp. Using WhatsApp means your messages/files are processed under WhatsApp’s terms in addition to ours. Operational messages (confirmations, checklists, payment instructions) are part of the service. (aqari.injazrt.ae)

• Where e-signatures or digital confirmations are used, you consent to transact electronically to the extent allowed by UAE law and DLD practice.

7) Fees & payments

• Government fees and service fees apply and may change without notice based on DLD schedules/circulars.

• Aqari supports DLD-approved payment channels (e.g., Noqodi/Dubai Pay and card). Payment credentials are handled by the payment provider; we store only necessary references/receipts. You’re responsible for bank charges and correct referencing. (noqodi.com)

• For some transactions outside Aqari scopes (e.g., property transfers), DLD or banks may require manager’s cheques or other methods defined by policy. (Engel & Völkers)

8) Your responsibilities

You will: (a) provide accurate, current information; (b) promptly respond to document or verification requests; (c) ensure payments are made via the instructed, approved channels; and (d) not upload malware or unlawful content.

9) AML/CFT, sanctions & compliance

We comply with UAE AML/CFT requirements relevant to trustee operations. We may request KYC/source-of-funds evidence and must refuse or report where required by law. (Industry guidance; trustee operations are overseen in DLD processes.) (Dubai Land Department)

10) Timing & availability

Turnaround depends on DLD systems, approvals, data validation, and payment confirmations. We don’t guarantee processing times or uninterrupted availability of Aqari, DLD portals, or payment networks. (Dubai Land Department)

11) Third-party platforms & links

Aqari links to third-party platforms (e.g., WhatsApp, Noqodi, DLD portals). Their terms and privacy policies apply, and we’re not responsible for their content, security, or availability. (aqari.injazrt.ae)

12) Intellectual property

All content on aqari.injazrt.ae (text, design, logos, layout and media) is owned by or licensed to Injaz. You may not copy, frame, scrape, or republish substantial parts without our prior written consent.

13) Privacy

Your personal data is processed in line with the Aqari Privacy Policy (PDPL rights, sharing with DLD/payment providers, retention, international transfers). Please review it before using Aqari. (aqari.injazrt.ae)

14) Disclaimers

• Aqari and its content are provided “as is”. Except where required by law, we disclaim warranties (express or implied) of accuracy, fitness for a particular purpose, and non-infringement.

• Guidance provided via Aqari is not legal advice; outcomes and fees are set by DLD. (Dubai Land Department)

15) Liability

To the extent permitted by law, Injaz is not liable for indirect, incidental, special, or consequential losses (including lost profits, data, or goodwill) arising from Aqari use, delays, or unavailability attributable to third-party platforms (e.g., DLD systems, payment gateways, carriers). Our total liability for any service provided through Aqari is limited to the Aqari service fee you paid for that matter (this does not limit liability that cannot be excluded by UAE law).

16) Indemnity

You agree to indemnify and hold Injaz, its officers, and staff harmless from claims, losses, penalties, and costs resulting from: (a) your breach of these Terms or applicable law; (b) inaccuracy/illegality of information or documents you submit; or (c) misuse of Aqari.

17) Force majeure

We’re not responsible for delays or failures caused by events beyond our reasonable control (including DLD or payment network outages, regulatory changes, internet failures, strikes, or extreme weather).

18) Changes to Aqari or these Terms

We may update Aqari or these Terms at any time. We’ll post changes with a new Effective date. Continued use of Aqari after changes constitutes acceptance.

19) Governing law & jurisdiction

These Terms are governed by the laws of the United Arab Emirates and applicable Dubai regulations. The courts of Dubai, UAE have exclusive jurisdiction unless mandatory law provides otherwise.
